These Terms of Service govern your use of the website located at www.brookhavenlandscapers.com and any related services provided by CareMax Brookhaven Landscapers. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.

Services

CareMax Brookhaven Landscapers provides landscaping services including but not limited to lawn care, landscape design, hardscaping, irrigation systems, tree services, and related outdoor property maintenance. All services are subject to availability and scheduling. We reserve the right to refuse service to anyone for any reason at any time.

Service estimates are provided based on the information available at the time of inspection. Final pricing may vary if conditions differ from initial assessments. Any changes to pricing will be communicated to you before work begins.

Payment Terms

Payment is due upon completion of services unless otherwise agreed upon in writing. We accept various forms of payment including cash, check, and major credit cards. For ongoing maintenance contracts, payment terms will be specified in your service agreement.

Late payments may be subject to additional fees. If payment is not received within 30 days of the invoice date, we reserve the right to suspend services until the account is brought current.

Cancellations and Rescheduling

If you need to cancel or reschedule a service appointment, please notify us at least 24 hours in advance. Cancellations made with less than 24 hours notice may be subject to a cancellation fee. We understand that emergencies happen and will work with you on a case-by-case basis.

Property Access

You agree to provide safe and reasonable access to your property for our team to perform the agreed-upon services. This includes ensuring that any gates are unlocked on scheduled service days and that pets are secured. If we are unable to access your property due to locked gates, aggressive pets, or other obstacles, you may be charged a trip fee.

You are responsible for marking any underground utilities, sprinkler lines, or other hidden features that could be damaged during our work. We will take reasonable precautions, but we are not responsible for damage to unmarked utilities or features.

Liability and Warranties

CareMax Brookhaven Landscapers is fully licensed and insured. We take great care in our work and will repair or replace any damage caused by our negligence. However, we are not responsible for pre-existing conditions, damage caused by weather events, or issues resulting from inadequate property maintenance prior to our services.

Plant warranties are subject to proper care and maintenance by the property owner. We cannot guarantee the survival of plants affected by extreme weather, disease, pests, or neglect after installation. Specific warranty terms will be provided in writing for applicable services.

Limitation of Liability

To the maximum extent permitted by law, CareMax Brookhaven Landscapers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or website. Our total liability shall not exceed the amount you paid for the specific service in question.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
